TERMS & CONDITIONS
By accessing Juster e-Commerce sites, you are agreeing to the following
terms and conditions (as modified from time to time), and each time
that you access Juster you reassert your agreement. If you do not agree
with these terms and conditions, then you may not access or use Juster.
Password
In
order to access Juster, you must present a valid password and user ID.
Your password is your sole responsibility, and you must take all
necessary actions to safeguard the security of your password and its
use in accessing Juster and ordering product via Juster.
Limited License
The information and databases provided to you via Juster are licensed to
you by Juster for your use only in the ordinary course of your business
for your review, selection and purchase of products from Juster. This
license is non-exclusive, non-transferable, and may be terminated by Juster with or without cause at any time.
Limitation of Liability
Except
as specifically stated herein, neither Juster nor will any of its
directors, employees or other representatives be liable for damages
arising out of or in connection with your use of Juster. This is a
comprehensive limitation of liability that applies to all damages of
any kind, including (without limitation) compensatory, direct, indirect
or consequential damages, loss of data, income or profit, loss of or
damage to property and claims of third parties.
Indemnity
You agree to defend, indemnify and hold Juster and its affiliates, and
their respective directors, officers, employees and agents, harmless
from and against any and all liabilities, costs and expenses, including
reasonable attorneys' fees, arising from or in any way relating to your
use of Juster.
Modification
This agreement sets forth the entire agreement and understanding of the
parties relating to the subject matter herein. Juster may modify these
terms and conditions, as well as the information and functionality of Juster, at any time. If Juster should make any changes to these terms and
conditions, you may be required to confirm your agreement to such
changes in order to access Juster.
Orders and Delivery
Juster may reject any order placed by customer if there is an
insufficient supply of products which prevent Juster from being able to
fulfill such order.
Delivery
times advised to customer are estimates only and Juster will not be
liable for any loss, damage or delay suffered or incurred by Customer
or its customers arising from late or non-delivery of the Products.
Returns Policy
Customer
must notify Juster in writing of any Products it wishes to return within
30 days from the date of the invoice relating to those Products. Each
claim for the return of Products by customer will be dealt with in
accordance with the Returns Policy. Any substitute Products to be
shipped to Customer in accordance with the Returns Policy will be sent
by Juster to Customer by ordinary freight pre-paid.
JusterU will not be liable for any damage or defects in the products that have
been caused by the improper storage, warehousing or transport, or by
any neglect, abuse or improper use, installation, maintenance or the
provisions of this do not extend to any products which have been added
to, varied, or otherwise modified by, any person other than Juster.
Cancellation
Unless otherwise agreed in writing by an authorized officer of Juster.
customer may not cancel an order which has been accepted by Juster.
If
Customer's right of cancellation is agreed to by an authorized officer
of Juster in writing, the right must be exercised by notice in writing
from Customer to Juster not later than 7 days before the estimated date
of shipment by the manufacturer or Juster (as the case may be). Unless
otherwise agreed between Juster and the customer, upon cancellation prior
to shipment, any deposit paid by customer will be forfeited to Juster.
Warranty
Products are covered by manufacturers' warranty.
BY ACCESSING JUSTER, YOU ACCEPT ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT.
